Bdas Global Limited its affiliated companies (together, the "Administrator", "we", "us") respects the intellectual property of others, and we ask our users to do the same. On this page, you will find information about copyright infringement procedures and policies that apply to https://Bdasglo.com.gh/ ("Website"), and how we respond to allegations of copyright violations.

Notification of Trademark Infringement

If you are a trademark owner (or an agent of a trademark owner) and believe any user material posted on our Website infringes upon your trademark, you can file a Notification of Trademark Infringement by sending a Notification of Trademark Infringement that meets the minimum requirements set out below at legal@bdasglo.com. Please note that if you fail to comply with all of the requirements, your Notification of Trademark Infringement may not be valid.

Your claim must include the following information (please note that all information must be submitted in English):

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the trademark that has been allegedly infringed;
  • a clear identification of the material you claim is infringing on the trademark, and information sufficient to locate that material on our Website (such as a URL or other location of the infringing material);
  • an ownership certificate of the allegedly infringed trademark, which must include the full name of the trademark, registration No., applicable region, the products and/or services involved in the trademark or provided by using the trademark, the name and address of the trademark owner);
  • provide a reasonably sufficient method of contacting you: email address would be preferred;
  • the following statement: "I have good faith belief that the use of the trademark described above and contained on the service is not authorized by the trademark owner, its agent, or by protection of law"; and
  • a statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the trademark owner.

We suggest that you consult your legal advisor before filing a Notification of Trademark Infringement. Please note that you may be liable for damages if you make a false claim of trademark infringement.

Once proper bona fide Notification of Trademark Infringement is received by us, we will take whatever action, in our sole discretion, we deem appropriate, including, without limitation:

  • removal or disabling access to the infringing material;
  • notifying the content provider, member or user that it has to remove or disable access to the material; and
  • terminating the repeat offenders' access to the service.

IPR Protection Policy

Overview

Bdas Global is committed to respecting Intellectual Property Rights ("IPR") and encourages its users to respect them as well. IPR infringements are dealt with severity on the "Bdasglo online marketplace" across its operating countries ("www.bdasglo.com").

Intellectual Property Right ("IPR") Protection

Listings of counterfeits or other unauthorized items are strictly prohibited on the Bdasglo online marketplace. Such listings are subject to removal by Bdasglo, and vendors who repeatedly breach Bdasglo's IPR Protection Policy are subject to expulsion from the Bdasglo online marketplace.

Repeated violations of our IPR policy will result in a range of actions, including but not limited to:

  • Removal of existing listings
  • Restriction of new listings
  • Removal from promotions
  • Account deactivation
  • Termination of membership service agreement

Bdas Global has full discretion to take any enforcement action it considers necessary for situations where vendors breach Bdasglo's IPR Protection Policy.

Infringement Claims

All IPR infringement claims are made under penalty of perjury. IPR holders and Bdasglo vendors agree to hold Bdas Global inculpably of all indemnity claims, causes of action, damages and judgments arising out of any removal of product listings resultant of IPR infringement claims.

As a neutral online marketplace providing services to both customers and vendors, Bdas Global does not adjudge conflicting IPR infringement claims. All conflicting claims shall be resolved by the relevant parties separately from Bdas Global and the Bdasglo online market place.
